Massachusetts arrests are usually held at Plymouth County Correctional Facility or transferred to Strafford County in New Hampshire, and increasingly to facilities in Texas and Louisiana. Hearings for detained New England cases run through the Boston Immigration Court and the Chelmsford court. • Flight risk: family, home, work, and time in the U.S.
  • Danger to the community: criminal history and rehabilitation
  • Prior removal orders and missed hearings
  • Whether mandatory detention rules block a bond entirely

Immigration bonds, explained

How an Immigration Bond Works in Massachusetts, From ICE Custody to Release

ICE arrests in Massachusetts are typically held at Plymouth County Correctional Facility, and many are transferred within days to Strafford County in New Hampshire or out of the region entirely. The Boston Immigration Court hears the detained docket. Locating the person and filing the bond request before a transfer is the priority.

  1. 01

    What an immigration bond is

Money paid to ICE so a detained person can be released while the case continues. It guarantees attendance at every hearing and is refundable when the case ends and every condition was met.

  2. 02

    Who sets the amount

ICE makes the first custody decision. If ICE denies bond or sets it too high, an immigration judge reviews it at a bond hearing (custody redetermination). Minimum $1,500; commonly $5,000 to $10,000.

  3. 03

    Who is eligible

Not everyone. Certain criminal convictions trigger mandatory detention, some recent arrivals are limited to an ICE parole request, and the rules changed in 2025 and 2026 and are being litigated.

  4. 04

    What the judge weighs

Flight risk and danger to the community. Family ties, a fixed address, work history, community support, court attendance, and rehabilitation evidence are the bond packet.

  5. 05

    How the bond is paid

A sponsor with lawful status pays ICE through the online CeBONDS system or at an ICE office; a licensed bond company can post it for a fee. Release usually follows within a day.

  6. 06

    After release

The case continues. Hearings must be attended and check-ins kept; a missed hearing can mean a removal order and a lost bond. We stay on as the defense team.

Common questions

Immigration Bond Questions From Massachusetts, Answered

Where are people detained by ICE in Massachusetts held?

Plymouth County Correctional Facility in Plymouth, MA (the main ICE detention site in Massachusetts); Strafford County Department of Corrections in Dover, NH (many Massachusetts arrestees are transferred here). Transfers between facilities and out of state are common in the first week, so we locate the person first and file where they are actually held.

How much is an immigration bond?

The legal minimum is $1,500. Immigration judges commonly set bonds between $5,000 and $10,000, and higher where flight risk or public-safety concerns appear. Family ties, a stable home, work history, court attendance, and rehabilitation evidence all move the number. The estimator on this page gives a typical range.

Can everyone detained by ICE get a bond?

No. Certain criminal convictions trigger mandatory detention, some recent arrivals are limited to a parole request to ICE, and the rules changed in 2025 and 2026 and are being litigated. Every case needs an individual review by an attorney.

How is the bond paid and is it refunded?

A sponsor with lawful status pays the full amount to ICE through the online CeBONDS system or at an ICE office; a licensed bond company can post it for a fee. The money is refunded when the case ends if every hearing was attended and every condition met.

How fast can a bond hearing happen in Massachusetts?

Typically within days to a few weeks of the request, depending on the facility's docket. The sooner an attorney files the motion with a complete packet, the sooner the hearing is set. Release usually follows within a day of payment.

Bond was denied or set too high. What now?

A denial or a high bond can be appealed to the Board of Immigration Appeals, and a new hearing can be requested when circumstances change. When detention drags on without any hearing, a habeas corpus petition in federal court can force one.
